Compliance with Park Rules. Customers must abide by all park rules. The most current rules and ordinances can be found on the Grand Traverse County Parks and Recreation main webpage, additionally, you will receive a copy as an attachment during the setup and again in the confirmation of your reservation.
Damages. All damages are the responsibility of the Customer.
Non-exclusive Use of Park. The customer shall make all reasonable efforts not to interfere with the use and enjoyment of common areas and non-leased areas of the facilities and grounds by the public or other user groups.
Waiver of Subrogation. To the extent permitted by law, Customer releases the Parks Department, its elected and appointed officials, employees and volunteers, and others working on behalf of the Parks Department from all liability or responsibility to the Customer or anyone claiming through or under the Customer by way of subrogation or otherwise, for any loss or damage to property caused by fire or any other casualty, even if such fire or other casualties shall have been caused by the fault or negligence of the Parks Department, its elected and appointed officials, employees or volunteers, or others working on behalf of the Parks Department. This provision shall be applicable and in full force and effect only with respect to loss or damage occurring during the time of the Customer’s occupancy or use.
Hold Harmless. To the fullest extent permitted by law the Customer agrees to defend, pay on behalf of, indemnify, and hold harmless the Grand Traverse County and its Parks Department, its elected and appointed officials, employees and volunteers, and others working on behalf of Grand Traverse County or it Parks Department, against any and all claims, demands, suits, or loss, including all costs connected therewith, and for any damages which may be asserted, claimed, or recovered against or from Grand Traverse County or the Parks Department, by reason of personal injury, including bodily injury or death and/or property damage, including loss of use thereof, which arises out of, or is in any way connected or associated with this agreement.
Force Majeure. The parties are not liable for failure to perform any obligation owed under this agreement if that failure is a result of an Act of God (e.g. fire, flood, or other natural disasters), war, government regulation or control, labor dispute, utility failure, or similar circumstances.
