City of Winona

The City of Winona hereby grants permission to use the Facilities as outlined, subject to the Terms and Conditions of this Agreement contained herein and attached hereto all of which form part of this Agreement.

The undersigned has read and on behalf of the Licensee agrees to be bound by this Permit/License and the Terms and Conditions contained herein and attached hereto, and hereby warrants and represents that he/she executes this Permit/License on behalf of the Licensee and has sufficient power, authority and capacity to bind the Licensee with his/her signature. Hold Harmless Agreement: The Licensee, on his own behalf and on behalf of the Licensee, agrees to indemnify, defend, and hold harmless the City of Winona and its agents and employees from and against all claims, damages, losses, and expenses, including attorney's fees, arising out of or resulting from licensee's use of the rented premises and/or the use of the rented premises by licensee's members and/or invites. I agree that my use of the rented premises by me and my invitees shall be at our sole risk and that the City of Winona shall not be liable for any claims, demands, injuries, damages, causes of action whatsoever to me or to my invitees due to the passive or active negligence of the City of Winona, its servants, agents and employees, from all such claims, demands, injuries, damages, actions, or causes of action whatsoever.
